1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Indian Mercado website and, for business customers, the Indian Mercado point-of-sale, inventory and restaurant management platform (together, the "Service"). By accessing our website or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of the Service

Indian Mercado provides a software platform for grocery, retail and restaurant businesses, including point of sale, inventory management, purchasing, restaurant and kitchen operations, customer loyalty, and reporting features. Access to the platform is provided under a separate agreement or order established when a business becomes a customer; these Terms apply generally to use of our website and, where applicable, the platform.

3. Account and business responsibilities

If you or your business is issued access to the Service, you are responsible for:

• Maintaining the confidentiality of account credentials and restricting access appropriately among staff;
• The accuracy of information entered into the platform, including product, pricing and inventory data;
• Ensuring your use of the Service complies with applicable laws, including tax and consumer protection laws in your jurisdiction; and
• Promptly notifying us of any unauthorized use of your account that you become aware of.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation;
• Attempt to gain unauthorized access to another business's data or account;
• Interfere with or disrupt the integrity or performance of the Service;
• Reverse engineer, decompile, or attempt to extract the source code of the platform, except where permitted by law; or
• Use the Service to transmit malicious code or engage in abusive or fraudulent activity.

5. Intellectual property

The Indian Mercado name, logo, website and platform, including their underlying software, design and content, are the property of Indian Mercado and its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. Data you enter into the platform as a business customer (such as your inventory, sales and customer records) remains yours.

6. Availability of the Service

We work to keep the Service reliable and available, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons outside our control.

7. Limitation of liability

To the maximum extent permitted by applicable law, Indian Mercado will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to limit liability in ways not permitted under applicable law.

8. Termination

We may suspend or terminate access to the Service for conduct that violates these Terms or poses a risk to other customers or the platform. A business customer's access to the platform itself is governed by the separate agreement or order under which that access was provided.

9. Changes to these Terms

We may update these Terms from time to time to reflect changes to the Service or for legal or operational reasons. We will update the "Last updated" date at the top of this page when we do. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
